Lease Termination Rights

The SCRA allows servicemembers to terminate residential and vehicle leases early when military orders require relocation or extended deployment. The termination is effective 30 days after the next rent due date following proper notice.

Qualifying Events

A servicemember may terminate a lease when military orders meet one of these criteria:

§3955 prohibits charging early termination fees or penalties for SCRA lease terminations. You cannot require forfeiture of the deposit as a termination fee, deduct "lost rent" for the remaining lease term, or charge administrative fees for processing the termination.
